JOB DESCRIPTION

RESULT OF SERVICE

The assignment will be carried out under the direct supervision of the Programme Officer of the Atlantic Ocean of the GMCP, based in Abuja, Nigeria.

The consultant will be based at her/his place. Once travel restrictions are lifted, travels will be envisaged to Ghana, Benin and Cote d’Ivoire in line with UN guidelines.
More specifically, the consultant will perform the following tasks:

Develop a workplan in consultation with UNODC GMCP;

Based on the existing findings of UNODC’s assessment, provide regular consultations on
the current legal reform of criminal code and criminal procedure code of Cote d’Ivoire, as
well as other areas where amelioration is required to be in line with UNCLOS;

Update the legislative assessment for Benin, Cote d’Ivoire, and Ghana conducted
previously by UNODC GMCP;

Develop factsheet on judicial capacity in investigation and prosecution of maritime crime including piracy, armed robbery, fishery crime, arms and drug trafficking, smuggling of migrants, oil bunkering and maritime environmental crime for 6 countries including Ghana, Nigeria, Togo, Benin, Cote d’Ivoire and Senegal

Provide monthly reports and other reports as required and agreed in the workplan.

DUTIES AND RESPONSIBILITIES

Piracy, armed robbery, drug trafficking and other illegal acts committed at sea plague the Gulf of Guinea with dire economic consequences for its riparian countries, including Ghana, Benin, and Cote d’Ivoire. Due to the reduced oil-prices and the weakened oil marked, attacks are no longer only targeting oil theft as previously seen, but also involving kidnappings for ransom, similar to
what was experienced in East Africa. The lack of prosecution related to piracy and armed robbery at sea continues to undermine efforts to combat such crime. It is important for the region to change this trend and ensure that there is no impunity to attacks at sea. The reason why most countries in West Africa are still not at prosecution stage is due to various factors such as limited national maritime capacities, absence of robust legal frameworks, insufficient domestic justice systems, and other factors inhibiting the legal finish of prosecution related to criminal activities at sea. This is emphasised by the fact that to date, there have been no successful prosecution for maritime piracy in West Africa. UNODC GMCP has been promoting legal reform and training maritime criminal justice
practitioners on the Law of the Sea and transnational organised maritime crime matters in the region. The support has comprised of legal assessments conducted with regard to piracy and maritime offences, establishing legal frameworks, and support in developing solid legislation in line with the UN Convention on Law of the Sea (UNCLOS) and other international maritime instruments. The GMCP is working currently on improving the criminal justice action and responses in Gulf of Guinea countries under the US-funded projects on “Strengthening the maritime crime legal frameworks in the Gulf of Guinea” and “Strengthen jurisdictional and criminal laws and practice to effectively prosecute piracy and other maritime crime through simulated crime scene exercise and trials to ensure legal finish in the region of the Gulf of Guinea”.

In line with these projects, the purpose of the consultancy is to support Ghana, Benin and Cote d’Ivoire’s prosecution authorities in improving their legal response to piracy, and other maritime crime. To do so, the incumbent will coordinate work of various national consultants working in ongoing legal reform initiatives in these countries. The incumbent will further develop factsheets on judicial capacity in investigation and prosecution of maritime crime including piracy, armed robbery, fishery crime, arms and drug trafficking, smuggling of migrants, oil bunkering and maritime environmental crime for 6 countries.

QUALIFICATIONS/SPECIAL SKILLS

Academic Qualifications: Advanced university degree (Master's degree or equivalent) in law, criminology, police administration or a similar field, focused on international maritime affairs, international security policy, criminal justice and / or the application of the law is required. An first level university degree in similar fields with additional two years of qualifying experience may be accepted in lieu of the advanced university degree;

Experience: At least ten years of progressively responsible professional experience in the field of countering maritime crime and implementing law of the sea is required;
Proven experience in legal research and analysis, proposals and training plans, and excellent drafting skills is required;
Experience in development work and legal systems in West Africa is a desirable;
Good communication and interpersonal skills are desirable;
Strong interpersonal and communication skills including demonstrated tact in inter-cultural communication is desirable;
Proven experience in dealing with national and regional counterparts from various cultural backgrounds is desirable;
Previous work experience with the UN or other International Organizations will be considered is desirable.

Language: English and French are the working languages of the United Nations. For this post, fluency in oral and written English and French are required. Knowledge of another official United Nations Secretariat language is an advantage.
